Rise Brewing sues Pepsico over trademark infringement for Mtn Dew Rise

Rise Brewing, a coffee beverage maker which has marketed its products to the convenience services trade, has sued Pepsico Inc. in federal court for trademark infringement, claiming Pepsi's Mtn Dew Rise drinks will be confused with Rise's canned cold-brew coffee, according to a Reuters report.

Pepsico did not respond to Reuters for a request for comment.

Alston & Bird, the law firm representing Rise, won a temporary restraining order in another case against Pepsico when it blocked the Pepsi's Gatorlyte hydration drinks launch. The law firm in March alleged Pepsi copied the trade dress of Laboratorios Pisa's Electrolit, a Mexican company. The parties settled the case later in March.
