Nespresso USA Inc. has sued Peet's Coffee in Manhattan federal court claiming that the company's coffee pods violate Nespresso's capsule design trademark rights, according to a Reuters report.
The suit claimed that Peet's capsules mislead customers through advertising to believe the pods are compatible with Nestle's Nespresso machine and that Peet's capsules were "nearly identical" to Nespresso's.
Nespresso also said Internet product reviews of Peet's pods refer to them as Nespresso pods and has asked the court to award the company profits from what it claims are infringing capsules.
Peet's declined to comment to Reuters.
A Peet's company spokesperson told Vending Times via email the company does not comment on pending litigation.
