The future of a residential driveway vending bank in Belleville, Ontario is uncertain after the Ontario Land Tribunal approved the withdrawal of an appeal by the business owner, Juan Hernandez, according to a quintenews.com report.
The existing lien on a semi-open structure covering the eight machines which have been in business for four years violates existing zoning laws since it was built without a building permit.
A new structure would be needed to the main dwelling to meet zoning laws.
Belleville council staff view the business as commercial while Hernandez believes it to be a home occupation not in need of zoning changes other than creating a new attached structure for the machines.
Hernandez can reapply to the council with an amended application.
Hernandez said he is unsure about the future.
