TRENTON, NJ -- A record-holding videogame player had his lawsuit against the Cartoon Network thrown out by a New Jersey Federal District Judge. Billy Mitchell, who has held world records for high scores on Donkey Kong, Pac-Man and Ms Pac-Man, sued the network over its portrayal of him in the "Regular Show" as a character named Garrett Bobby Ferguson.
But according to Judge Anne Thompson, the portrayal is protected under the First Amendment.
"The television character does not match the plaintiff in appearance," Thompson noted in her decision. "GBF appears as a nonhuman creature, a giant floating head with no body from outer space, while plaintiff is a human being. And when GBF loses his title, the character literally explodes, unlike the plaintiff."
A superstar within the gaming community, Mitchell has set several world records. He was the first to surpass one million points on Pac-Man and Ms Pac-Man, and was featured in the 2007 documentary "The King of Kong."
