Admiral Beverage, based in Worland, Wyoming, has sued PepsiCo Inc. in federal court for breaching a contract to exclusively manufacture Rockstar energy drink, according to a K2radio.com report. Admiral is seeking a preliminary injunction to maintain its exclusivity rights.
Admiral claims that PepsiCo took away its right to a market consisting of parts or all of Wyoming, Utah, Montana and Idaho. This occurred when the Wyoming company refused to sign an e-commerce agreement allowing PepsiCo to sell its brand to online retailers, and allowing those retailers to sell Pepsi brands to consumers located in the bottlers' exclusive territories.
