Court Awards Joe Loparcos Companies Full Ownership Of Revive Self Service Caf

CHARLOTTE, NC -- Claimants in a lawsuit have won full ownership of Revive Self Service Café, a micomarket company. The final judgment entered in the Superior Court of Mecklenburg County, NC, awarded full ownership of Revive and its associated technologies to two companies belonging to Joe and Susan Loparco. The suit was filed by Zzyzx Solutions LLC and Molti Tutti Inc. against Assert Control, RSSC's founder. Financial terms were not disclosed.

The Loparcos established Zzyzx Solutions to serve as the owner of Revive's software. Zzyzx then entered into an exclusive licensing agreement with Molti Tutti, d/b/a Revive Self Service Café, which sells a micromarket kiosk to vendors with a nonexclusive license to operate the software; Molti Tutti provides software and hardware support. According to Joe Loparco, Zzyzx and Molti Tutti have always owned the intellectual property and licensing rights to sell and support the Revive micromarket.

The judgment also found that Adam Arthur, an RSSC founding partner, had breached his fiduciary duties to the companies. As a result, Arthur was ordered to relinquish his Revive shares. According to Joe Loparco, Arthur is no longer associated with companies and is prohibited from competing with them in the automated self-checkout space.

The judgment also reaffirms that Zzyzx and Molti Tutti are the sole owners of the software, including all adaptations, versions and derivative works, as well as the software's source codes.

"My wife Susan and I are gratified by the results, and happy to put this extremely difficult period behind us," said Loparco. "We sincerely thank the many loyal Revive micromarket users who supported us throughout the process, and we look forward to aggressively expanding that customer base in 2016 and beyond."

Founded in 2012, Revive is has a no-commission model and monthly maintenance fee. Operators can brand the kiosk as they wish, control their own data and choose their own payment processor.
