SAN JOSE, CA-- (Posted April 10) Namco announced on April 7 that it had filed a suit and obtained an injunction against a seller of counterfeit arcade video games, PC Amusements (Orlando, FL), and its owner, Luis Molinary. The counterfeit video games were being sold to the public through various outlets, including Internet auction sites. Namco, which owns the rights to the popular "Pac-Man" and "Galaga" video games, filed suit in the Orlando Federal District Court, which granted an order allowing the U.S. Marshal Service to seize and impound the counterfeit video games and the parts thereof. Namco America president Kevin Hayes said: "Namco will not hesitate to enforce its strong intellectual property rights, trademarks and copyrights against those who seek to trade on its valuable video game properties." Namco's legal counsel Neil A. Smith, intellectual property specialist attorney at Howard Rice Nemerovski Falk Canady & Rabkin in San Francisco added: "The courts will grant immediate restraining orders and seizure orders when provided with strong evidence of trademark and copyright counterfeiting, as is the case here." Namco's suit is seeking an injunction, monetary damages and attorneys' fees. In addition to the seizure order, the Federal Court issued a restraining order. Namco is advising operators to buy its games only from the company's authorized dealers and distributors.
