INCREDIBLE TECHNOLOGIES POINTS TO MARCH 11 HEARING

ARLINGTON HEIGHTS, IL - (Posted February 28) The U.S. district court in the case of Incredible Technologies vs. Global VR set March 11 for a pretrial hearing on alleged infringement of copyright and trade dress, as well as IT's other charges. Plaintiff IT said the order indicated "that the trial'will move forward quickly" and quoted the judge as stating, "There are some fairly dramatic similarities in terms of the design and layout of the control panel." IT president Elaine Hodgson said: "Although the judge denied the motion for a TRO [temporary restraining order against GVR] we are pleased and encouraged by the judge's orders, which recognize the serious nature of this case. To have the judge indicate that their game is a copy legitimizes everything that we are fighting for." She added that IT will "vigorously pursue" the case. A spokesman for GVR told VT that the lawsuit involves no allegation of infringement regarding the "EA Sports PGA Tour" video game program itself, which was licensed and adapted from a consumer title originally created by Electronic Arts. EA is not a party to the lawsuit. VT will post further updates on this evolving story as it becomes available.
