SAN JOSE, CA -- (Posted March 13) Global VR today announced that it has filed a counterclaim against Incredible Technologies, which originally sued GVR last month for alleged copyright infringement. Global VR's suit alleges violations of the federal antitrust laws and the Illinois Consumer Fraud and Deceptive Business Practices Act. GVR also cites IT for "tortiously interfering with" Global VR's commercial relationships. According to a statement from Global VR, the suit alleges that "IT sought to obtain and maintain a dominant position in the coin-op video golf market through intimidation and other exclusionary practices, including IT's filing of a frivolous copyright and trade dress lawsuit and making false and misleading statements, such as the claim that Global VR operators would have to remove all 'EA Sports PGA Tour' products from establishments. Global VR also alleges in its counterclaim that IT has threatened distributors, operators and vendors in an attempt to maintain its dominant position and thwart legitimate competition." Officials said Global VR is seeking a permanent injunction against Incredible Technologies' practices as well as treble damages and attorneys fees. Global VR also today filed its formal reply to the initial IT lawsuit, denying copyright infringement and trade dress infringement.
