NAMA Offers Update On FDA Nutritional Label Rulemaking Progress

CHICAGO -- The Food and Drug Administration said its calorie disclosure rules for nutrition labeling on vending machines will be issued by March 23.

"Very importantly, the FDA said that final rules won't be put into place in 2011," said National Automatic Merchandising Association senior vice-president of government affairs Ned Monroe. "So vending is unlikely to have any enforcement of calorie disclosure before the middle of 2012."

Monroe noted that the Federal Register has printed information from the FDA regarding public comments on the economic impact of menu labeling and calorie disclosure. These appear in the Jan. 31, 2011, edition (Vol. 76, No. 20). The association has submitted comments. | SEE COMMENTS

FDA invites further comments, which must be submitted by March 2. Anyone wishing to comment may contact Monroe at nmonroe@vending.org. The next opportunity to comment will occur in late March, when the vending rules are published.

Monroe also reported that the FDA has removed its menu labeling guidance to chain restaurants: "In the Federal Register of Jan. 25, 2011, (76 FR 4360), FDA announced the withdrawal of this draft guidance and its intention to complete the notice-and-comment rulemaking process for section 4205 before initiating enforcement activities based, in part, on extensive comments on the draft guidance submitted to the Agency."

He explained that this guidance withdrawal does not affect vending.
