New York Considers Sales Tax Exemption Bills; NAMA Marshals Support For Plan

ALBANY, NY -- The New York State Legislature is considering a pair of bills to increase the sales tax exemption for food and beverage items sold through vending machines. Assembly Bill 05718 and Senate Bill 3445 would amend the state tax law to increase the sales tax exemption from 75¢ to $1.50. Thus, certain vended items would be tax exempt when sold for $1.50 or less.

In 2000, the Legislature exempted food and beverage items from the state sales and use tax when sold in vending machines for 75¢ or less, in an effort to help the vending industry remain competitive with over-the-counter retail channels.

However, few items currently sold in vending machines in New York cost 75¢ or less. The National Automatic Merchandising Association contends that increases in product and operating costs, combined with the effects of normal inflation, have made the value of the 75¢ exemption minimal.

NAMA is asking New York vending operators to contact their legislators to urge their support of the proposed legislation. "The vending industry in the state of New York has been in decline over the past several years. Therefore the sales tax exemption must increase in order for the industry to remain competitive in both pricing and convenience," the association said in a bulletin to its New York members.

"A.05718 and S. 3445 could provide much needed economic relief for your businesses and provide countless consumers with continued access to your high-quality vended products," NAMA said. "Most important, these legislative amendments will provide a boost in our state's economy by protecting the thousands of jobs that the vending industry supports."
