Dave & Buster's Hacker Says He's Innocent

BOSTON -- Albert Gonzalez, leader of a ring of thieves who stole 130 million credit and debit card numbers from retailers including Dave & Buster's from 2003 to 2008, said he wants to withdraw his guilty plea.

As previously reported in VT, Gonzalez pled guilty last year and received a 20-year federal prison sentence, the longest ever for a cyber crime. | SEE STORY

But on March 24, Gonzalez's attorney filed a petition in the U.S. federal district court here to overturn both his conviction and sentence. Gonzalez claimed his crimes were committed with the full knowledge of -- and in compliance with orders from -- U.S. Secret Service agents.

Other companies targeted by the five-year theft included Heartland Payment Systems, retailers T.J. Maxx and Office Max.

There was no comment on Gonzalez's petition from the Secret Service. Wired magazine reported that Gonzalez was indeed serving as a confidential informant for the agency on a separate matter while he was stealing credit card numbers from D&B's and others.

Gonzalez is serving his sentence in a Michigan prison.
