Indiana Smoking Ban Challenged In Court

LIGONIER, IN -- American Legion Post 243 filed a lawsuit in federal court on June 21, moving for a preliminary injunction to stop state officials from enforcing Indiana's new smoking ban. The state Legislature passed the smoking ban in March, and it went into effect on June 24.

The lawsuit argues that the ban violates equal protection provisions in the state and federal constitutions because it applies to fraternal organizations while exempting other types of venues. As reported by VT, the ban exempts bars and taverns. | SEE STORY
