NY Maintains 75¢ Vending Sales Tax Exemption

ALBANY, NY -- New York vending operators have escaped a repeal of the current vending tax exemption that was under consideration by the state Legislature, according to New York State Automatic Vending Association president Mike Esposito, Prestige Services (Clifton Park, NY).

However, despite NYSAVA's efforts to convince lawmakers to vote in favor of raising the existing exemption to apply to vended food and beverages priced at $1 or less, the Legislature decided to maintain the current exemption for items priced at 75¢ or less.

In 2000, lawmakers exempted food and beverage items sold in vending machines for 75¢ or less from state sales tax to help the vending industry remain competitive with over-the-counter outlets.

In recent months, NYSAVA has been enlisting its members to support two bills -- sponsored by William Magee in the Assembly (A.7679a) and David Valesky in the Senate (S.4280a) -- which propose to amend the New York state tax law to exempt food and beverages sold through vending machines for $1 or less.

Separately, New York's vending operators celebrated another hard-won victory in June, when lawmakers passed a budget that did not include the 1¢-per-fl.oz. sweetened beverages tax proposed by Gov. David Paterson to help close the state's budget deficit. See story.
