MADISON, WI -- A federal grand jury in the Western District of Wisconsin has charged David R. Biggerstaff with embezzling from his vending company's employee pension benefit plan.
The indictment alleges that from October 2007 through January 2009, Biggerstaff stole $25,194 from Premier Vending Inc.'s 401(k) plan by withholding employee contributions and failing to make payments to it on their behalf.
At the time of the alleged offense, Biggerstaff was president of Janesville, WI-based Premier Vending Inc., formerly Owen Vending Inc., and was the trustee for the company's pension plan.
If convicted, Biggerstaff, 55, faces a maximum penalty of five years in federal prison.
The charge against him is the result of an investigation by the Chicago regional office of the U.S. Department of Labor, Employee Benefits Security Administration. The case will be prosecuted by Assistant U.S. Attorney Peter M. Jarosz.
