Benchmark chief executive Al Kress said the licensing agreement protects Benchmark's U.S. patent for a "grid skill amusement game or dispensing device," which is the same one that covers the Hypoluxo, FL, company's Drill-O-Matic. Andamiro USA president Satinder Bhutani said his company will build Winners' Cube and market it worldwide.
Kress said Benchmark will aggressively pursue any infringing products. Imports or sales of unlicensed copies of Winners' Cube or similar games might infringe Benchmark's U.S. patent, he added.
Benchmark said it has already negotiated a one-time license with a U.S. operator who had allegedly imported an infringing product. In addition, Benchmark's counsel has secured a "substantial royalty" from another U.S. operator who has agreed to stop the importation of infringing games.
